1. About These Terms
These Terms and Conditions govern the provision of electrical, security, and home automation services by Sydney Electrical and Automation Pty Ltd (ABN 42 690 377 130) to clients in New South Wales. By engaging us you accept these terms in full.
These terms apply to quotations, work orders, and ongoing service arrangements unless a separate written agreement expressly replaces them.
2. Licensing and Compliance
All electrical work is performed by licensed electrical contractors holding current NSW electrical contractor and electrician licences. Work is performed in accordance with AS/NZS 3000 (Wiring Rules), AS/NZS 3018 (Electrical Installations for Patient Areas), AS/NZS 3760 (In-service Safety Inspection and Testing), and any additional standards relevant to the specific scope.
Certificates of Compliance for Electrical Work (CCEW) are issued where required by NSW regulation. A copy of each CCEW is provided to the client and lodged with the distributor.
3. Quotations and Scope
Quotations are valid for 30 days from the date of issue unless otherwise specified. Quotations are prepared on the basis of information available at the time of site assessment and may be revised if site conditions, material availability, or scope change.
Any variation to the agreed scope will be documented and priced in writing before work proceeds. Verbal instructions for variation are not binding.
4. Payment Terms
Domestic work: a deposit of 30 to 50 percent (subject to quote) is payable on acceptance of the quotation. Progress payments may be billed at pre-agreed milestones for works exceeding two weeks. Any remaining balance is payable within 7 days of completion.
Commercial work: standard terms are 7 days from invoice date. Scheduled maintenance contracts are billed monthly in arrears. Where late payments occur due to internal accounts processing, this should be communicated to our accounts team to ensure no additional late payment fee is incurred.
Late payment interest of 2 percent per month on the remaining balance may be applied to overdue amounts in accordance with Australian commercial practice.
5. Warranty
Workmanship is warranted for a period of 12 months from the date of practical completion. During this period, we will rectify any defects arising from faulty workmanship at no additional cost, provided the issue is reported within the warranty period.
Manufacturer warranties apply to all materials, fixtures and equipment supplied and installed, and will be passed on to the client where applicable. Any claims relating to manufacturer defects are subject to the respective manufacturer's terms and conditions.
This warranty is strictly limited to the original scope of works completed and does not extend to damage resulting from misuse, neglect, accident, or external causes; normal wear and tear; overloading or use of electrical installations outside of intended capacity; unauthorised alterations, modifications, or repairs carried out by others after completion; works or materials not supplied or installed by us; existing wiring, infrastructure or concealed conditions that were not identified at the time of installation; or environmental factors, including water ingress, corrosion, vermin, or acts of nature.
Any works found to be outside the scope of this warranty may be quoted and charged accordingly. Call-out fees and labour charges may apply where the fault is not attributable to our workmanship.
6. Access and Site Conditions
The client is responsible for providing safe and timely access to the site. Delays caused by inaccessibility or unsafe conditions may result in rescheduling fees equal to the labour cost of the affected crew.
Where work requires temporary disconnection of power, the client will be notified in advance and best efforts made to minimise disruption.
7. Liability
Our liability is limited to the cost of rectification of defective workmanship within the warranty period, to the maximum extent permitted by Australian Consumer Law.
We are not liable for consequential or indirect loss, including loss of profit, loss of data, or loss of use, arising from delays or defects, except as required by law.
Our public liability insurance covers up to twenty million dollars and certificates of currency are available on request.
8. Cancellation
Cancellation by the client within 48 hours of a scheduled appointment may incur a fee covering scheduled labour and any non-returnable materials already ordered. Cancellations with more notice carry no fee.
9. Privacy
Personal information collected during the engagement is handled in accordance with the Privacy Act 1988 (Cth). Information is used solely to deliver our services, issue invoices, and meet regulatory obligations.
10. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any dispute not resolved through good-faith negotiation will be submitted to the courts of New South Wales.
